Terms of Service
1. Introduction and Scope
Makumbi Phone Stores operates an online and offline retail platform for mobile phones, accessories, and electronic products. These Terms of Service (“Terms”) govern your access to and use of the website, mobile applications, digital wallet, and related services (collectively, the “Platform”). By accessing, browsing, registering, or purchasing from our Platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform. Continued use constitutes acceptance of these Terms (Return and Refund Policy Sections 1-10, Privacy Policy Sections 1-7).
2. Definitions
- User / Customer: Any individual accessing, using, or purchasing products via the Platform.
- Wallet: Digital balance linked to user account for purchases, refunds, or withdrawals (see Section 7, Return and Refund Policy Sections 4 and 7, Privacy Policy Sections 1-2).
- Product: Any phone, accessory, or electronic device sold by Makumbi Phone Stores.
- Refund: Repayment issued under conditions defined in the Refund Policy (Return and Refund Policy Sections 2-6).
- Platform: Website, mobile applications, and related services.
3. Eligibility and Acceptance of Terms
Users must be at least 18 years old or have consent from a parent/legal guardian. Users must have legal capacity to enter into a binding agreement and comply with Ugandan laws. Continued use constitutes a legally binding agreement (Return and Refund Policy Sections 1-2, Privacy Policy Sections 6-7).
4. Account Registration and Security
Users must provide accurate, complete, and up-to-date information when creating an account. You are responsible for account confidentiality. All activities under your account are your responsibility. Makumbi Phone Stores shall not be liable for losses from unauthorized access caused by negligence. Information is collected and used according to Privacy Policy Sections 1-6.
5. Products, Descriptions and Availability
Product descriptions, specifications, and prices are provided for reference and may be updated at any time. Product images are illustrative; actual product may vary in color, packaging, or appearance. Customers are solely responsible for reading and fully understanding all product descriptions, specifications, and details before placing an order. Failure to do so may affect eligibility for refunds or returns (Return and Refund Policy Sections 2, 5, 6). Customers are advised to contact support for clarification before purchase.
6. Pricing and Payments
All prices in Uganda shilling unless stated otherwise. Payments processed through supported Mobile Money services or approved payment gateways. Orders confirmed only after payment verification. Refunds follow Section 9 and Wallet Policy (Section 7, Return and Refund Policy Sections 4 and 7).
7. Wallet Policy
Minimum Wallet deposit: Uganda shilling 5,000. Wallet funds for Platform use only. Withdrawals and refunds subject to 10%-13% transaction/service charges. Wallet withdrawals take 2-7 business days depending on payment provider (Return and Refund Policy Sections 4 and 7). Inactive Wallets (365 days) may be suspended after notice period of 30 days.
8. Delivery Policy
Kampala deliveries: 30 minutes-1 business day; Upcountry: up to 7 business days. Products sourced abroad: 5-10 business days; orders are final once confirmed. No refunds or cancellations during delivery period unless required by law (Return and Refund Policy Sections 5-6). Customers must provide accurate delivery info; Makumbi Phone Stores not liable for delays caused by customer error or external circumstances.
9. Refunds and Returns
All refunds/returns governed by Return and Refund Policy. Users should review that Policy. Wallet refunds follow Section 7; delivery restrictions explained in Section 8.
10. Warranty Disclaimer
Some products may have manufacturer warranties; coverage subject to manufacturer terms. Warranties exclude misuse, accidental damage, water damage, theft, or unauthorized repairs (Return and Refund Policy Sections 2 and 6).
11. User Conduct and Responsibilities
Users agree not to engage in fraudulent, misleading, or unlawful activity; not to abuse promotions, Wallet, or pricing. Violations may result in account suspension, termination, or legal action (Return and Refund Policy Section 9).
12. Limitation of Liability
Makumbi Phone Stores' total liability limited to the amount paid for the transaction. Not liable for indirect, incidental, or consequential damages.
13. Intellectual Property
All content on Platform is property of Makumbi Phone Stores or its licensors. Unauthorized use prohibited.
14. Suspension and Termination
Accounts may be suspended or terminated for Terms violations, fraud, or abusive behavior (Return and Refund Policy Section 9). Termination does not affect accrued rights.
15. Customer Protection and Fair Trading
Makumbi Phone Stores commits to transparent, lawful practices. Products must match descriptions at purchase (Return and Refund Policy Sections 1-6). Customers' rights under Ugandan law are not limited. Wallet withdrawal fees, transaction charges, refunds, and non-refundable products remain applicable.
